MELFORT, SASK. - A judge's decision to sentence a man convicted of sexual assault to no jail time will be appealed.

The Saskatchewan Justice Department says it will appeal the sentence given to a man convicted of sexually assaulting a 12-year-old girl.

Um, NTW is sort of spinning here. The fact is the men were convicted. The judge felt that the circumstances were such that a prison term was not necessary. One reason the judge cites is that the girl initiated the acts. Having seen cases I can imagine facts under which the judge's decision could be reasonable, such as if the girl looked much older and lied about her age, and so on. Statutory rape cases can be tricky.

The girl's "aggression" isn't an "excuse" for their behavior, rather it is a "mitigating circumstance" in selecting a punishment. Sizeable difference. I have a feeling the article's description of the situation is bourne more out of sensationalism than truth.

Yes, I can see it that way. I have never met a 12 year old girl that looked old enough to be of an age to consent. That doesn't mean they don't exist.

I don't recall the ages of the men being given, either. They may have been 19 year old men. Yes, statutory rape cases are tricky, I agree.

This is tricky indeed, because we don't know many of the details, having had the whole issue stuffed down our throats by someone who wants to create a fight instead of actually have a dialog.

Perhaps if we moved into a non-NTW thread we could have a discussion, I don't know.

I used to live in Saskatchewan, and I remember racism being very strong by whites toward Native Indians. I wonder if the 12 year old girl had been white would things have been handled differently.
It's purely speculative on my part, but the socio-economic plight suffered by Native Indians is deplorable in Saskatchewan, and I've often felt their rights are compromised because of racism that is deeply rooted in the system.

Again, I don't know enough about this particular case to start making such judgments. I'm only thinking back on the kind of things I saw go on when I lived there.
