There is no constitutional basis for what the five drongos on the Supreme Court pulled, either. Big whoop.

Why shouldn't the Executive branch be allowed to set requirements for contractors as it sees fit? After all, John Galt can simply not bid on the project, Magical Free Market hand and all that.
